Artikel 2 – Toepasselijkheid / Article 2 – Applicability

1. Het gebruik van deze website is onderworpen aan de hierna opgenomen algemene voorwaarden.U wordt geacht hiervan kennis te nemen.

2. Deze algemene voorwaarden zijn van toepassing op elk aanbod van Flying Fox BV en op elke tot stand gekomen overeenkomst tussen Flying Fox BV en u als consument.

3. De consument erkent kennis te hebben genomen van deze algemene voorwaarden en deze te hebben aanvaard bij het plaatsen van zijn of haar bestelling.

4. De algemene voorwaarden kunnen steeds zonder aankondiging of kennisgeving aangepast, gewijzigd, aangevuld of verwijderd worden.

Artikel 3 – Het aanbod en de bestelling / Article 3 – Offer and order

1. Indien een aanbod een beperkte geldigheidsduur heeft of onder voorwaarden geschiedt, wordt dit nadrukkelijk in het aanbod vermeld.

   Flying Fox BV kan steeds telefonisch of via email gecontacteerd worden voor extra informatie.

Artikel 4 – Prijs / Article 4 – Pricing

1. De prijzen zijn in euro, inclusief 21% BTW en exclusief verzendkosten.

2. Voor een bestelling geldt altijd de prijs die op het moment van de bestelling geldt. Indien korte tijd later een reeds aangeschaft product afgeprijsd blijkt te zijn, kan er geen aanspraak gemaakt worden op de terugbetaling van het prijsverschil.

Artikel 5 – De betaling / Article 5 – Payments

1. Na de plaatsing van de bestelling zal een bevestiging met betalingsgegevens aan de consument meegedeeld worden.  Het totaalbedrag incl. BTW dient binnen de 7 werkdagen overgeschreven te zijn met vermelding van het ordernummer.

2. Tot 7 werkdagen na het plaatsten van de bestelling worden de goederen gereserveerd voor de consument.  Indien binnen deze termijn de betaling niet ontvangen is, wordt de bestelling automatisch geannuleerd.
   The goods are reserved for the consumer up to 7 working days after placing the order. If the payment has not been received within this period, the order will be automatically canceled.
3. Na ontvangst van de betaling zal de bestelling klaargemaakt worden.
   After receiving the payment, the order will be prepared.
4. De geleverde producten blijven eigendom van Flying Fox BV tot ze volledig betaald zijn.
   The ordered products remain the property of Flying Fox BV until they are paid in full.

Artikel 6 – Levering en uitvoering / Article 6 – Delivery 

1. Als plaats van levering geldt het adres dat de consument aan Flying Fox BV kenbaar heeft gemaakt.  Indien dit niet juist blijkt te zijn, is dit de verantwoordelijkheid van de consument en kan het zijn dat er extra kosten in rekening moeten gebracht worden om dit te corrigeren.

2. Indien de bezorging vertraging ondervindt, of indien een bestelling niet dan wel slechts gedeeltelijk kan worden uitgevoerd, ontvangt de consument hiervan uiterlijk 30 dagen nadat hij de bestelling geplaatst heeft bericht. De consument heeft in dat geval het recht om de overeenkomst zonder kosten te ontbinden.
   If the delivery is delayed, or if an order cannot or only partially be executed, the consumer will be notified of this no later than 30 days after he has placed the order. In that case the consumer has the right to terminate the agreement without costs.
3. In geval van ontbinding conform het vorige punt zal Flying Fox BV het totaalbedrag van de bestelling dat de consument betaald heeft zo spoedig mogelijk, doch uiterlijk binnen 30 dagen na ontbinding, terugbetalen.
   In the event of dissolution in accordance with the previous point, Flying Fox BV will refund the total amount of the order that the consumer has paid as soon as possible, but no later than 30 days after dissolution.
4. De opgegeven levertermijnen zijn slechts indicatief. Flying Fox BV kan niet aansprakelijk gesteld worden voor de schade veroorzaakt door niet (tijdige) levering.

5. Flying Fox BV kan niet aansprakelijk gesteld worden voor eventueel opgelopen schade door vertragingen buiten zijn wil om.

Artikel 7 – Herroepingsrecht / Article 7 – Right of withdrawal

1. Bij de aankoop van producten of diensten heeft de consument de mogelijkheid de overeenkomst zonder opgave van redenen schriftelijk te ontbinden binnen de 14 kalenderdagen. Deze bedenktermijn gaat in op de dag na ontvangst van het product door de consument.

2. Tijdens de bedenktijd zal de consument zorgvuldig omgaan met het product en de verpakking. Indien hij van zijn herroepingsrecht gebruik maakt, zal hij het product met alle geleverde toebehoren, in de originele staat en verpakking en bijgeleverde documenten (leverbon) als dusdanig perfect verkoopbaar binnen de 14 dagen op eigen risico en op eigen kosten terugsturen naar Flying Fox BV, Antwerpse Steenweg 73, 2620 Hemiksem, Belgie. Binnen een termijn van 30 dagen zullen de teruggestuurde producten worden terugbetaald exclusief de verzendkosten die gemaakt zijn door de consument.

Artikel 8 – Uitsluiting herroepingsrecht / Article 8 – Exclusion of the right of withdrawal

1.  De consument beschikt niet over het recht om van de aankoop van een product af te zien:

Artikel 9 – Klachtenregeling / Article 9 – Complaints

1. Klachten kunnen naar Flying Fox BV, Antwerpse Steenweg 73,2620 Hemiksem, België gestuurd worden of via email naar info@flying-fox.be.

2. Klachten over de uitvoering van de overeenkomst moeten binnen bekwame tijd, volledig en duidelijk omschreven worden ingediend bij Flying Fox BV nadat de consument de gebreken heeft geconstateerd.

3. De ingediende klachten worden binnen een termijn van 14 dagen gerekend vanaf de datum van ontvangst beantwoord. 4. Indien de klacht niet in onderling overleg kan worden opgelost ontstaat een geschil dat vatbaar is voor de geschillenregeling (Artikel 14).

Wij gebruiken de gegevens om de bestellingen zo snel en gemakkelijk mogelijk te laten verlopen. Voor het overige zullen wij deze gegevens uitsluitend gebruiken met de toestemming van de consument. Flying Fox BV zal de persoonlijke gegevens niet aan derden verkopen en zal deze uitsluitend aan derden ter beschikking stellen die zijn betrokken bij het uitvoeren van de bestelling.

1. Bij eventuele geschillen tussen de consument en Flying Fox BV is het Belgische recht van toepassing en is het vredegerecht van het kanton of de rechtbanken van het arrondissement van de bedrijfszetel van Flying Fox BV bevoegd.
